Until minutes ago I had expected to be present at Murray's funeral but I am now unable to be present and so I wanted to express my condolences and sympathy in writing. I had enormous respect for Murray. As a young lawyer I once asked Murray for advice on a jury trial I was about to start. His words, a mixture of wisdom, humour and what I would call warm cynicism reflecting his astute understanding of law and life, are words I have never forgotten. In a legal world where trials are becoming increasingly acrimonious Murray set a high standard of civility and grace while being enormously persuasive and effective as an advocate. At the end of a trial with Murray you were not just still friends but better friends. Every juror I ever spoke to who heard a case Murray tried had nothing but praise and admiration for him. I have heard judges say they were looking forward to a trial with Murray. I don't think any lawyer could reasonably expect to achieve more than that. Murray was an exceptional lawyer and friend and he will be sorely missed.

in 1964, my dad built a house at 12 Summit Ave. Murray and Sue lived next door. Memories. The 1963 black Pontiac that Murray lent me for a date. The key to the law office on Kirkland Street to 'study' for my grade 13 departmental exams. Sue in her halter top (burned into a 17 year old brain!!) The basement workshop with Murray and Lew sharing moments.
Later, as a young teacher, Murray and the School Board. The Greg and Agnes saga, the quiet confidence of Trevor, Lisa, my little bb, and the enigmatic Cindy.

My first encounter with Mr. Ellies was at my Grade 13 Commencement where, as Vice-Chairman of the Kirkland Lake Board of Education, he spoke to the graduates. Little did I know that two months later I would begin my career as a legal secretary/law clerk under his tutelage. Forty three years later we bid farewell to an amazing journey. When I was a child, I was very gullible. I often used to ask Bapa why he didn't have any hair on top of his head. His reply to me was simple: "Nessie, I do have hair on top of my head," he would say "it's just invisible". He would then invite me to touch the invisible hair. I would run my hand over the bald surface and truly believe that I could feel his invisible hair. I was amazed. My bapa had the best sense of humour of anyone I've ever known. He knew exactly what to say or do to make me laugh, or to put a smile on my face. He was an incredible man, and I'm going to miss him for the rest of my life.

I met Murray when I was 18. I was dating Greg at the time. I wanted to get my driver's licence before I went back to France as it is unfordable there. I had been practising with Sue's car and Greg for a couple of weeks and one morning, Murray said to me: "Why don't you drive me into town?" He had a beautiful cadillac and I had no experience driving such a big car! I was pretty nervous as you can imagine. We were in Kenogami and he asked me to stop at Delean's Esso to gas up. I carefully manoeuvered to get close to the pump but I hit one of the stands near the pump. He never lost his cool and just said with a little smile: "That is a little too close" This is the type of sweet guy Dad was. At the time he had no idea I would become his daughter in law and that he would become my second Dad. He was the most patient and loving person I have ever met and I will miss him tremendously. The family won't be the same without him. I love you Dad.

My best friend (Ashley Chirico) and I planned a trip to Florida when we were 20 to spend the week with Bapa.
It was the best week. Bapa took us wherever we wanted to go. He brought us to Chili's to have his favourite Margherita's and also to the Sawgrass Mills Mall. He wanted nothing more than to see us happy. We taught him lyrics to some of the more recent music on the radio. Every day, Bapa would take us to the beach. Ashley and I were in charge of making some deliciou sandwiches and packing our cooler. We then would set up our chairs on the beach and Bapa would get his gear on and go for his daily walk along the boardwalk. I know that Ashley and I will never forget that week and cherish those memories. I love you so much Bapa and miss you terribly.

The practice of law will not be the same without Murray. Who is going to make us laugh till we have tears in our eyes? Who is going to keep us captivated for hours with legends of legal battles? Who is going to be against me in Court and make the expirience a magnificent pleasure? Greg my deepest condolences. I wont be able to be in North Bay as I have a 3 days hearing with the Chief Justice of Quebec in Montreal (baby case) that has been scheduled for over 9 months on Wednesday, Thursday and Friday, but I will be thinking of you and your family as you mourn the passing of Murray. I have not stopped thinking about Murray since I heard the news early yesterday.It doesn't seem real and I know that the North will never be the same without him. I will miss arguing cases opposite him. Although we represented adverse interests, it was always a magnificent pleasure to be in Court with Murray. What a loss !!!!!

I found out about Murray leaving us this morning from friends on a facebook site titled 'you know you are from Kirkland Lake, when'...Murray would have been amused at the site and the social implications of so many KLer's gathering to discuss so much.....stuff...Needless to say the news of Murray's passing has saddened me greatly, as he played such a large part in day to day life in KL.The pickerel in Kenogami can now breath a sigh of relief, but my condolences to you Sue, Greg and the rest off the family. "Unpretentious and never taking himself seriously" such an accurate description of Murray! Always smiling when he dropped in the store. Full of advice on the latest products he was using on his woodworking projects. Never knew how he could have so much energy! Gave our Dad some valuable advice when he retired. Always had time on Fridays when they were in KL to pick up and drop off our Mom and Irene Freedman for supper usually at the Brige in Kenogami. Thanked him numerous times and he said he enjoyed it more becuase he got to "tease them for the whole evening"! Gerry O'Connor, Morris Freedman now Murray... heaven will never be the same! Murray Ellies had such a profound influence on a whole generation of lawyers in this area including me. I recall just starting out and losing my mind defending someone as duty counsel over some small petty offense. The crown went right over the top demanding that these kids who were playing their rock and roll music loudly be tarred and feathered and placed in the stockade. ( sorry crowns, slight exaggeration Sitting down beside me during the break, I asked him what he was in court for. He tells me that he is defending someone for MURDER. Gasp, I'm awestruck. He then turns to me, sighs and confides in me as if I was an old colleague, he shakes his head, "I have to wait here all day for the team of Crowns to arrive. He goes on whispering You know , crowns these days..... they take these Murder charges so !@#$ seriously!!!!" The fact is that he did take his job very seriously and the message was loud and clear, no matter what the charge no matter what the challenge, stay cool and don't lose your mind. What he also took very seriously was helping out all of the lawyers around him by truly caring and liberally and freely doling out the wisdom and frankly the nobility of his practice. He was a true gentleman lawyer of the highest quality and will be truly missed.

We are all poorer for the loss of Murray. I doubt there is any member of the bar in northeastern Ontario who will have produced more stories. My former partner Ted Byck has a great tale about his first encounter with Murray on a Landlord and Tenant matter early in Ted's career which I hope he'll share. There is another one about an OPP sting designed to extract one of Murray's early radar detectors, but I don't know if anybody could do it justice like Murray did. Here's my contribution. In the late 80's or early 90's I was involved on behalf of a lender in a foreclosure action heard in Haileybury. I think the property was a Kirkland Lake hotel, and there were several mortages. We didn't see many foreclosure actions, particularly ones which involved disputes over priorities among the lenders, so the three or four of us acting as counsel to the lenders were doing our best to work collaboratively to understand what was clearly unfamiliar terrain, and to avoid embarrasing ourselves before Mr. Justice Bernstein. Murray, inevitably, was our spokesman. He was on his feet in full rhetorical flight, providing the judge with a seamless dissertion on the law, when I realized he was headed to the wrong conclusion. I was sitting to his right at the counsel table and tugged on his gown. Unperturbed, he brought his argument to a forceful closing, then looked down. I handed him the gospel, I think it was Marriot & Dunn, and without a word pointed to the paragraph which addressed the point he had just put to rest incorrectly. It didn't take him five seconds to digest what was on the page. "And, Your Honour," he resumed, sweeping up the book as if he had planned to read from it all along, "Until just now I believed that to be the law on the matter. However, my friend has kindly drawn my attention to ..." and so on. Unflappable. We all, including I think Judge Bernstein, struggled briefly to maintain composure, while Murray brought it all home safely. Farewell, Murray, we will never forget you. I am standing as I send this. And by the way, somebody Thursday or Friday, had better tell the story of Luigi, the deaf and dumb bookkeeper to the mob.

Murray, you were a delight inside and outside the courtroom. I always knew that your superb trial skills made me a better prosecutor. You had that innate ability to see the weaknesses in the witness' evidence and use them to your advantage. I started my career in Toronto, and saw some of the great criminal trial lawyers, and I always knew you ranked right up there with them. I am just glad I took the time to tell you how much I enjoyed working with you. No matter how fierce our battles inside the court, we were always able to smile, laugh and be friendly outside those doors. I attempted to catch that fish last summer, with Bapa and Mel. The only thing I caught was the anchor! Then, before I could try again he took one look at the sky and said, "we better head back in we've got 5 minutes until the storm hits." We headed back and within 5 seconds of docking, the skies opened up. Obviously, he knew the skies well on Kenogami. I truly enjoyed my time there with him and any other time spent together over the past 6 years or so. Selfishly, I wish there would be many more years. rest in peace Bapa, your legacy lives on.

I imagine that everyone has more Murray stories than they can remember. Murray was already legendary when I started to practice law in 1986. From the first time that I dealt with him, when I was barely called to the bar, he was always polite, instructive, courteous and always had time to share advice. My most compelling memories of Murray, however, are all about his sense of humour. Whether it was me calling him and trying to strong arm him into settling a case when I was barely practising 1 year (Murray's reply - "Now I know why they call you hopeful"), to him telling me with a grin how he got into the elevator at a courthouse, with a lady passenger, complaining out loud to no one in particular about the reputation of a female Justice before whom he had not yet appeared, only to learn that she was his elevator companion, Murray showed us all how to keep things in balance. From Fort Albany to Toronto, everyone in this business has heard stories of Murray's legendary trial expertise and has shared his good will and his good humour. Farewell, Murray. I will miss you.
